Welcome to the Davis Bell McCraith Wines Terms & Conditions for use. By registering your details or placing an order you agree to be bound by the Terms & Conditions set out below. If you have any questions regarding these before you register or place an order, please contact us at info@dbmwines.co.uk or telephone 0117 370 9930 between 9am and 5pm Monday to Friday.

We reserve the right to amend these Terms & Conditions from time to time, so please check these regularly. Your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change.

1. USE OF THE WEBSITE

Registration and Ordering

You warrant that:
  • The Personal Information which you are required to provide when you register as a customer is true, accurate, current and complete in all respects; and
  • You will notify us immediately of any changes to the Personal Information by updating your information online or by contacting us by email at info@dbmwines.co.uk or by telephoning 0117 370 9930 between 9am and 5pm Monday to Friday.
  • You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.
  • You are at least 18 years of age (see Age Restrictions below).

Age Restrictions

The UK Licencing Act 2003 states that it is against the law to sell or supply intoxicating substances to persons under 18 years of age in the UK. Davis Bell McCraith Wines is committed to upholding both their legal and social obligations as a wine and spirit retailer. For clarity, a drink containing alcohol is classified as intoxicating if it contains more than 0.5% alcohol by volume. By registering your details or placing an order you confirm that you are at least 18 years of age. If our carriers are in doubt of the age of the recipient of an order they will request some form of ID. In the event that this is not satisfied they are not permitted to leave the wine.

Indemnity

You agree fully to indemnify, defend and hold us, and our officers, directors, employees, agents and suppliers, harmless immediately on demand, from and against all claims, liability, losses, costs and expenses, including reasonable legal fees, arising out of any breach of the Terms & Conditions by you or any other liabilities arising out of your use of this website, or the use by any other person accessing the website using your account and/or your Personal Information.

Third Party Links

Davis Bell McCraith Wines assumes no responsibility whatsoever for any links to the internet or other third party websites from its website. Once you activate these links you will leave this website and Davis Bell McCraith Wines will not be responsible, or liable, for the content or privacy practices of any other websites on the internet to which you may visit from this site.

Davis Bell McCraith Wines also prohibits all persons from providing hypertext or other links to the dbmwines.co.uk website (other than to our home page) from their website or from a third party's website without our prior written consent.

Our rights:

We reserve the right to: Modify or withdraw, temporarily or permanently, this website (or any part thereof) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the website.

All text and graphics used, unless specified, are directed solely at those who access the website from the United Kingdom mainland. Davis Bell McCraith Wines makes no representation or will not be held liable for any action placed upon the website by individuals from other locations.

2. PRIVACY & SECURITY

Data Protection

Davis Bell McCraith Wines is fully committed to the Data Protection Act 1998 and is dedicated to the privacy of your information. We will not release your personal information to any company outside Davis Bell McCraith Wines for mailing or marketing purposes unless you have given us your express permission to do so. However you should be aware that if we are requested by the police of any other regulatory or government authority investigating suspected illegal activities to provide your Personal Information and/or User Information, we are entitled to do so.

Credit card details

We do not store any credit card details on the website. We use encryption systems to ensure credit card details are sent in secure format and we will continue to use new security protocols and software as they become available. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part, we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the website.

Internal use of personal information

We collect personal information when you join Davis Bell McCraith Wines or when you make a purchase from this website. The information is used to enable us to process and deliver your order. By registering your details on this website, you consent to Davis Bell McCraith Wines maintaining, recording, holding and using personal data we collect about you. Information can also be collected to allow Davis Bell McCraith Wines to send you offers which we feel will be of particular interest to you. You agree that you do not object to us contacting you for any of the above purposes whether by telephone, email or in writing and you confirm that you will not consider any of the above as being a breach of any of your rights under the Privacy and Electronic Communications (EC Directive) Regulations 2003.

Davis Bell McCraith Wines uses 'cookies' placed in the browser file to help us collect general information about the behaviour of visitors on our site. This helps us to constantly monitor and improve our website's functionality and personality.

3. PURCHASE OF PRODUCTS

Products

Vintages, labels and closures may vary from those shown on the website. All wines are 75cl and all spirits 70cl unless otherwise stated. We make every effort to ensure information on the website and in our literature is up-to-date and accurate. However Davis Bell McCraith Wines takes no responsibility whatsoever for information that is incomplete, inaccurate or out of date. Davis Bell McCraith Wines shall not be held liable to any individual or business for any damage or loss which may have occurred from the use of any matter contained on this website or in other Davis Bell McCraith Wines literature.

Payment

We accept the following major payment cards only: Visa, MasterCard, Electron, Maestro, Solo. Payment will be debited from your account upon receipt of your order. You are responsible for confirming that you are the legitimate holder of the credit/debit card and that your details are correct. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment, we will not be able to process your order and a message will appear informing you that the transaction cannot be processed. All products are offered subject to availability and remain the property of Davis Bell McCraith Wines until payment is received in full.

Prices

Prices are subject to currency and market fluctuations, changes in duty and VAT, as well as stocks remaining unsold. We reserve the right to change price and availability without notice.

Substitutions

If we have run out of an item, we reserve the right to replace out of stock items with another of equal or greater value. Occasionally we may have to substitute wines for a later vintage.

Cancellation of Orders

You may cancel your order up to and including 14 working days from the date of delivery, provided that all bottles are unopened and intact. We will refund the price of the order including delivery and arrange collection. If we find that the product has not been returned to us in a fully resaleable condition, we reserve the right to refuse a refund on the item.

En Primeur Orders 

En Primeur Orders are exempted from the right to cancellation under the consumer contracts regulation 2014.

4. DELIVERY

Our deliveries are usually made by public carrier. It is essential to check all goods before signing for them. If you are unfortunate enough to receive a damaged consignment, please write 'Damaged' clearly on the consignment note beneath your signature and notify us within 24 hours of delivery. We will refund the price of the item or send a replacement as appropriate.

If you have not received your wines within 7 days of ordering, please advise us by email at info@dbmwines.co.uk or call us on 0117 370 9930 between 9am and 5pm Monday to Friday.

Goods requested to be delivered unsigned for are left at your own risk and we cannot be held liable for any loss or subsequent damage.

Purchasers must be at least over 18 years of age. If our carriers are in doubt of the age of the recipient of an order they will request some form of ID. In the event that this is not satisfied they are not permitted to leave the wine.

5. REFUND POLICY

In the event of a young wine being faulty, please keep the bottle and its contents and email us at info@dbmwines.co.uk or telephone 0117 3709930 (9am-5pm Monday-Friday) and where wines are currently available from importers or growers we will endeavour to arrange a replacement or a refund as appropriate. Whilst every effort is made to check the provenance and condition of all our mature wines we cannot be held responsible for any wine later found to be out of condition.

6. INTELLECTUAL PROPERTY RIGHTS

All copyright, database rights, trademarks and any other intellectual property rights in and to the content on this website and other Davis Bell McCraith Wines literature, such as text, graphics, logos, banners, images, buttons, underlying source code and software, is the sole property of Davis Bell McCraith Wines, or the applicable licensor. Any use (including copying, reproduction, duplication, transmission, or display of the content of this website, without the express permission of Davis Bell McCraith Wines for purposes other than the viewing of information or for ordering purposes, is strictly prohibited.

Permission is granted to electronically copy, and to print in hard copy, portions of this website for the sole purpose of placing an order with Davis Bell McCraith Wines or using this website as a shopping resource.

7. ADDITIONAL CONDITIONS FOR MEMBERS 

Monthly subscriptions

Members may take out a monthly subscription with Davis Bell McCraith Wines by standing order with their bank. This service is only available by standing order. Members may increase, decrease or cancel their subscription at any time by giving notice in writing to Davis Bell McCraith Wines, 14 Kings Road, Clifton, Bristol BS8 4AB . Any outstanding balance must be paid in full.

Account balances

It is the member's responsibility to ensure that sufficient funds are available to pay for any purchases, and delivery charges. The company reserves the right to charge interest at 2% per month on overdue amounts. Credit is provided solely at the discretion of Davis Bell McCraith Wines. In the event of non-payment of invoices, Davis Bell McCraith Wines reserves the right to sell part or all of the member's stock and to deduct from the proceeds the outstanding charges.

En Primeur Purchases

Wines offered "En Primeur" can only be purchased by direct telephone request or by post. "En primeur" orders taken will be subject to confirmation by Davis Bell McCraith Wines by post. Payment for "En Primeur" wines can only be taken by cheque or bank transfer. 

8. GENERAL

We reserve the right to refuse supply to any individual or business.

Severance

If any part of the Terms & Conditions shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed to be severable from the Terms & Conditions and shall not affect the validity and enforceability of any of the remaining provisions of the Terms & Conditions.

Law

The Terms & Conditions shall be governed by and construed in accordance with the laws of England and you irrevocably submit to the exclusive jurisdiction of the courts of England.
